The Servihabitat Servicios Inmobiliarios, S.L.U. company (hereinafter "Servihabitat") with Tax ID B-66082629, registered in the Commercial Register of Madrid in volume 37153, folio 143 and page M-663089, with registered offices at Avenida de Burgos, 12, 28036 Madrid, is the holder of the licence to use the domain http://www.servihabitat.com/. This company provides certain real estate and financial asset management services to various companies, in the broadest sense and by any means, including via the Internet, by managing and operating websites.
Access to the www.servihabitat.com site and information on any of the products and services contained in the same implies acceptance of the terms and conditions set forth in this Legal Notice. We therefore recommend that you read its content carefully if you wish to access and use the information and services provided by the said site.
Validity of information
These terms and conditions are valid from the date of their last update.
Servihabitat reserves the right to modify them at any time, in which case they shall take effect from their publication and shall be applicable to all users of the site from that date.
The content of the website, in particular the information and advertising references, are solely for the purpose of providing commercial information services, and no transactions involving electronic commerce, not even reservations, may be made through the website. Servihabitat reserves the right to include modifications or to partially or totally omit the existing content of the site whenever it deems appropriate, or to temporarily or permanently prevent or restrict access to the same.
General privacy policy
1. Data Controller and Data Processor. Data Protection Officer
Servihabitat is responsible for the processing of data collected through the different formats included in this website (hereinafter, the Website), as well as data provided through any other Servihabitat channel.
Servihabitat may act on behalf of a third party who holds rights over the property or financial assets it manages, and this third party may therefore be required to provide Servihabitat with certain information, including personal data of third parties relating to these assets. In this case, Servihabitat will process such data in its role as Data Processor, solely in accordance with the instructions of the owner of the assets, the Data Controller.
In fulfilment of the services provided to the titleholders of the above-mentioned assets, Servihabitat may obtain personal data about the data subjects from the following publicly-accessible sources: Courts, public administrations, land registries, electronic land registry office, official state auction portal, other public auction portals such as those of the social security, other public or private entities, such as town councils and municipal housing companies, homeowners' associations, business report providers (Axesor, Empresia, Infocif, Informa, Iberinform, Empresite, Expansión, Einforma, DowJones), notaries, insolvency administrators, BOE, BORME, public insolvency register, yellow pages and similar postal services, google maps, real estate agents or property administrators.

2. Purposes of processing and Legitimation
Servihabitat collects personal data in order to process them for the purposes and in accordance with the legitimate bases of the processing detailed below:
- Based on your consent, we will process your personal data:
- To be able to deal with your queries, questions or requests made through the customer service or communication channels identified on the Website and, where appropriate, to be able to contact you, including by electronic means, such as e-mail, message or instant messaging (whatsapp, sms or other similar systems), in order to process them.
- To send you transactional and/or commercial communications, by electronic means such as email or instant messaging, adapted to your preferences about our products or services, creating a commercial profile based on the asset searches you have previously carried out.
- To manage your subscription to our Newsletter and send it periodically to the e-mail address you have provided for this purpose.
- To provide and manage the services requested.
- To evaluate your proposed purchase or investment in any of the real estate or financial assets that we manage.
- To respond to your request and provide you with advice in relation to your offers.
- To manage your collaboration request to market the real estate assets that Servihabitat has in its portfolio. The data processed for this purpose will only be processed in a professional sphere.
- When you register on the website, you can do so as a professional (investor) or as an individual. You can register by providing us with the requested data directly or through your Facebook, Instagram or Google account. In any case, the personal data requested for such purposes will be processed for:
- Managing your registration on the website, creating a user account and enabling subsequent access to your account and the available functions.
- Managing your enquiries.
- Sending you information or contacting you by electronic means, such as e-mail or instant messaging and telephone to inform you about products or services about which you have shown interest or which meet the search requirements you have indicated.
- Informing you of possible price variations in respect of the assets you have informed us of.
- Saving your asset searches for future visits to our website and allowing you to keep track of the assets you bookmark.
- Showing you Servihabitat advertising according to your preferences in search engines and social networks.
The data that we request from you on each of the forms provided for this purpose or by telephone when you contact us through this channel are strictly necessary, therefore, if you do not provide them we will not be able to process them for the purposes indicated above.
You may withdraw any of the consents given at any time, without this having any consequences or influence on the other purposes for which you do not withdraw your consent. Without prejudice to the above, if you withdraw any of the aforementioned consents, we will not be able, where applicable, to deal with your request, maintain your registration, send you commercial communications or newsletters, evaluate your request for collaboration or provide you with the services requested.
- In compliance with legal obligations to which Servihabitat is subject, we will process your personal data in order to:
- Comply with the due diligence measures established in Law 10/2010 of 28 April, on the prevention of money laundering and the financing of terrorism, as a regulated entity.
The data we request from you for this purpose are necessary to comply with our legal obligations, so if you do not provide us with them we will not be able to accept or evaluate your offer.
- If you are an entrepreneur or are self-employed, we may process your personal data based on Servihabitat's legitimate interest, for the following purpose:
- To be able to invite you to Servihabitat's professional events that may be of interest to you, the legitimate interest pursued by Servihabitat being that of establishing a possible business relationship or maintaining an existing one.
The personal data we request from you for this purpose are strictly necessary to invite you to and manage the professional event in question.
- We will process your personal data for the following purposes, based on your contractual relationship with Servihabitat or pre-contractual situations:
- To manage the commercial, contractual or any other type of relationship you have with Servihabitat.
The data requested within the framework of any commercial or contractual relationship that you maintain with Servihabitat are strictly necessary to manage and maintain this relationship, so failure to provide them may result in the termination of said relationship, without any liability for Servihabitat or any rights in your favour. Similarly, the data that we ask you for in order to adopt any pre-contractual measure that you request will be those necessary to be able to carry it out, so if you do not provide them we will not be able to adopt it, without this giving rise to any liability for Servihabitat or any right in your favour.
3. Obligation to provide certain personal data and to keep it up to date.

Servihabitat guarantees that when you notify us, your data will be rectified. Therefore, any communication from Servihabitat addressed to the contact details you have provided us with at any given time will be considered valid.
We also inform you that, where you have given your consent, your identification and contact details may be provided by our partners, so that we may contact you, including by digital means, to inform you about our products, activities and services.
4. Sending commercial communications
Servihabitat, as part of its commercial activity, may provide you with resources for registering or subscribing to company news or commercial information. Such resources will always be subject to your consent to forward them to you.
If you have authorised us to do so, Servihabitat may send you advertising content based on the alerts you have set up about products, activities and services by electronic means, such as e-mail or instant messaging.
You may withdraw your consent to receive marketing communications at any time, as set out in section 7 of this Policy.
5. Automated Decisions and Profiling
For some services, we may use automated means for the processing of personal data, meaning that certain decisions are taken automatically without human intervention. However, such profiling does not entail any legal or similar effects and the personal data processed are those which are strictly necessary,
For example, if you have selected products under favourites, communications informing you that the property is still for sale or rent.
6. Duration of processing and storage period
The data processed with your consent will be processed and kept for as long as you do not withdraw said consent, except for those processed to deal with your queries, questions or requests made through the customer service or communication channels identified on this website or by telephone, which will only be kept for as long as it is required in order to assist you.
Personal data relating to your registered user account on the portal will be retained until you request the deletion of your user account.
Data processed in compliance with the applicable regulations on money laundering will be processed and retained for the period of time established therein and used on the basis of the legitimate interest pursued for as long as you do not object to such processing.
Furthermore, any data processed within the framework of the contractual relationship with Servihabitat or for the application of pre-contractual measures will be processed for the duration of said relationship or the execution of the pre-contractual measure, and will be kept thereafter for the period of limitation of the actions and liabilities arising from the aforementioned relationship.
Furthermore, whether you ask us to delete your account, using the following link available here, or you ask us to delete your data and/or you withdraw your consent, using the means identified in section 7 of this Policy, your personal data will only be kept and will be duly blocked for the time period prescribed by law or for the formulation, exercise or defence of claims arising from the processing of your data.
7. Rights of the data subject
You may revoke your consent and/or exercise your rights of access, rectification, deletion, limitation of processing, data portability and opposition with Servihabitat, free of charge, as well as withdraw your consent at any time, by sending your request in writing including the reference "Personal Data" to Carretera de Esplugues, 225, 08940 Cornellà de Llobregat (Barcelona) or by sending an e-mail to [email protected], specifying which right you wish to exercise.

All users have the opportunity to join the pages or groups that Servihabitat has in different social networks.
However, you should be aware that, unless we request your data directly (for example, through marketing activities, contests, promotions, or any other valid way), your data will belong to the relevant Social Network, so we recommend that you carefully read its terms of use and privacy policies and make sure that you configure your preferences regarding the processing of your data.
9. International Transfers
Servihabitat keeps your data in the European Union (EU) or the European Economic Area (EEA).
If, in the future, we need to provide them to service providers located in a third country or to an international organisation, either because of the need to provide you with the requested service or in order to provide you with the service with the highest quality standards, Servihabitat undertakes to apply all the measures and controls to guarantee and protect the processing of said personal data in compliance with the applicable regulations and to provide you with the information required by the regulations in this regard.
10. Recipients of personal data
We will not share your data with any third parties, except to the following categories of recipients:
- With providers who provide a service to us (e.g. website maintenance, support services).
- With those for which we have previously informed you and you have given us your consent (e.g. so that they can offer you services related to the assets you are interested in, such as financing).
- With Public Administrations, Security Forces and Corps, Courts and/or Tribunals to comply with our legal obligations and/or for legal actions, the formulation, exercise or defence of claims arising from the processing.
11. Modification of the Privacy Policy
Servihabitat may update this Privacy Policy as often as it deems appropriate and at its own discretion or to adapt it to legislative or doctrinal changes. We will inform you of such changes and updates by publishing them on the website or by notifying you via the contact details available to us, when the modifications so require, in accordance with the applicable regulations.

Servihabitat does not guarantee continuous access, nor the correct viewing, downloading or use of the elements and information contained in the pages of the portal, which may be impeded, hindered or interrupted by factors or circumstances beyond its control.
Furthermore, it is not responsible for the information and other contents included in third-party spaces or web pages accessible from the portal via links or hyperlinks, nor for the information or other content included in third-party spaces or web pages from which the portal or any of its web pages are accessed via links or hyperlinks, nor for the information and contents of any third-party web page that is presented under the appearance or distinctive signs of Servihabitat, unless expressly authorised by Servihabitat. Notwithstanding the above, it undertakes to do everything possible to avoid the existence of illicit content on its website and, in the event that it has actual knowledge of such content, to remove it or prevent access to it.
Servihabitat accepts no liability whatsoever in relation to the information, contents of any kind, products and services offered or provided through the portal by third-party companies, persons, collaborators, users or entities, even if they belong to the same economic group, and in particular for damages of any kind which, linked to the above, may be caused by: (i) absence or deficiencies in the information provided to users or in its truthfulness, accuracy and sufficiency; (ii) non-performance or defective or untimely performance of contracts or pre-contractual relations; (iii) failure to comply with the obligations incumbent on information society service providers; (iv) infringement of consumer and user rights; (v) Infringement of intellectual and industrial property rights, acts of unfair competition or unlawful advertising; (vi) infringement of the right to data protection, of professional secrecy and of the rights to honour, personal and family privacy and personal image; and (vii) in general, non-compliance with any applicable laws, customs or codes of conduct.
